Most of us will never have to worry about pollution claims which are excluded from Commercial General Liability (CGL) policies. Pollution policies are intended to cover both clean-up costs and liability. If your business uses or could somehow produce (read mold) pollutants you need to carefully consider pollution insurance.

Biohazards and biowaste produced in almost every medical and veterinary practice are considered pollutants and are not covered in a CGL policy. Consider a simple blood sugar test; a finger prick, a small amount of blood and voila – a biohazard. You are probably contracting with a disposal company to remove the biohazard bags from your office, but you “own” those materials for ever. If their truck is involved in an accident or they dump them in an ordinary landfill, you are still responsible. So, ask to be named as an additional insured on their policy, get a certificate of insurance, and consider your own pollution policy.
